Data Protection Law
Your
privacy, and the way that we use your data, is protected by law.
Data
protection law states that we are allowed to use your personal information if
we have a proper, lawful basis (reasons) to do so. This may include sharing
that information with third parties, such as suppliers, as we are required to
do, in order to provide goods and services to you.
The
reasons must be one or more of the following:

a legitimate interest of our business

interests (to protect someone‘s life)
Legitimate
Interest is when we have a valid business reason to use your information. When
we do, it must not go against what is right and fair to you.
Types of information that we
hold

course of conducting our business and providing goods and services to you, we
hold the least amount of information possible in order to correctly go about
our business.
We
would collect and hold the following information:

details, including name, address, contact numbers, and email address.

information, detailing any consents or preferences that you‘ve given us,
relating to how we contact you.
- Contractual
information, such as quotes provided and orders we are fulfilling or have
fulfilled for you
- Payment
information, which is held purely for means of collecting a payment, and is
then destroyed promptly
- Technical
information, relating to the products you have from us, or are being supported
by us.
General
documentation, relating to project or order (contract) specific information to
help us to fulfil a contract with you, including after sales service. This
could consist of emails or letters that you have sent us, or notes of
conversations you have had with us.

There

Who we share this information

The
only time we share your information with third parties, is for the purpose of fulfilling
contracts with you, or providing a service to you, that you have requested.
Only essential information will be shared.
We may

consent, it may prevent us from providing goods or services to you.

have the right to object, or request us to stop using it, delete it, and the
right to be forgotten.
There
may be a legal or regulatory reason that prevents us from deleting your data.
You
can ask us to restrict the use of your data, which would mean that we can only
use it in future for legal reasons, whilst the restriction is in place.

personal information

Sharing data outside of the EEA
We do
not ordinarily share data outside of the EEA, and will only do so at your
request, to fulfil your requirements, or for an overriding legal reason.
Length of storage of personal
information
We
will keep your information as long as you are a customer of ours. If you cease
to be a customer, we may keep the information for up to six years afterwards,
so that we may be able to check and respond to any questions or complaints that
may arise.

PRIVACY POLICY FOR THE TOTAL HOME ENVIRONMENT HPV SERIES CONTROL APP

I. General
This
Privacy Policy sets our how Total Home Environment Ltd, Kenton House,
Oxford Street, Moreton in Marsh, GL56 0LA handles your data in
connection with the Total Home Environment HPV Series Control App
('App') and to what extent it is used. This Privacy can be accessed at
any time in the App's menu under 'Privacy' or on the page of our website https://www.totalhome.co.uk/privacy.asp
II. Data collection, storage and use
The
collection, storage, modification, transmission, blocking, deletion and
use of your personal data is carried out on the basis of the applicable
legal provisions, in particular the Data Protection Act 2018. Your data
is used exclusively to enable you to use the app. Total Home
Environment reserves the right to use your data in anomynized form, in
order to improve the services offered.
Your
data will only be communicated to third parties to the extent
necessary, in particular for the performance of services on our behalf
in compliance with the statutory permission requirements and/or in the
context of commissioned data processing in accordance with the Data
Protection Act 2018. In doing so, we observe the principle of data
economy. The data will also be used to communicate with you.
The
data you provide during the registration process (username and
password) will be stored directly in the App. Asset values are not
stored permanently, as they are reloaded from the asset every time you
log in to the app and at regular intervals (when the app is open in the
foreground).
III. Data transfers
A
server infrastructure operated by Amazon Web Services ("AWS") is used
to connect/pair the App with your heat pump unit ("System") and to
process data within the framework of the App. AWS is certified by robust
security standards, including ISO 27001, SOC 1/2/3, and PCI DSS Level
1. The data controller is Zimmermann Luftungs & Warmesysteme
GmbH & Co. For more information on AWS's terms of use and data

The
values collected by the system (including but not limited to: the
operating mode, the room temperature, the activation of heating elements
and cooling, the hot water temperature, the electric heating immersion
activation, the ventilation level, the limits for CO2 and humidity as
well as settings for the timer program) and the device ID are transmitted
in encrypted form to an AWS server within member states of the European
Union and from there forwarded to the App. The IP of your smartphone or
tablet is only transmitted to AWS for identification purposes and is
not stored or merged with other data.
IV. Your rights under GDPR
You have the
right to be informed, of access, to rectification, to erasure, to
restrict processing, to data portability and to object. You have the
right to withdraw your consent for us to use your data, at any time.
There may be a legal or regulatory reason that prevents us from deleting
your data. If you wish us to stop using your data, please contact Total
Home Environment via info@totalhome.co.uk or write to us at Swallow
House, Cotswold Business Village, Moreton in Marsh, GL56 0JE. Please
note if you withdraw your consent, the App can no longer be used (as
there will be no registered user account) or linked to a system and will
prevent a full diagnostic service to you.
